Please read these Terms of Use ("Terms") carefully before using Somnia ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using Somnia, you confirm that you are at least 13 years of age and agree to comply with these Terms and all applicable laws and regulations.
2. Description of Service
Somnia is a personal dream journal app that allows you to log dreams, track moods and recurring symbols, view personal insights, and optionally request AI-generated dream interpretations.
3. AI-Generated Content — Disclaimer and Limitation of Liability
THIS IS THE MOST IMPORTANT SECTION. READ IT CAREFULLY.
- For Entertainment Only. All AI-generated dream interpretations, follow-up analyses, symbol explanations, and any other AI-produced content within the App are provided strictly for entertainment and personal reflection. They are not professional psychological, medical, psychiatric, or therapeutic advice.
- No Warranties. AI-generated content is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.
- AI Hallucinations and Errors. AI models can and do produce content that is factually wrong, contextually inappropriate, emotionally insensitive, or entirely fabricated ("hallucinations"). You must not rely on AI-generated content for any decision affecting your health, safety, relationships, or well-being.
- No Liability. Under no circumstances shall Somnia, its developers, affiliates, or licensors be liable for any direct, indirect, incidental, special consequential, or punitive damages arising from your use of or reliance on AI-generated content, including but not limited to emotional distress, psychological harm, or decisions made based on AI outputs.
- You Assume All Risk. By using the AI features, you expressly acknowledge that you use them at your own risk and that you are solely responsible for any actions you take based on AI-generated content.
- Not a Mental Health Tool. Somnia is not a mental health tool, diagnostic instrument, or therapeutic platform. It does not screen for, diagnose, or treat any mental health condition. If you are in crisis, contact emergency services or a crisis hotline (e.g., 988 Suicide & Crisis Lifeline in the US).
4. Premium Subscription
- Somnia offers optional premium features, including unlimited AI dream interpretations.
- Subscription pricing and terms are displayed at the point of purchase.
- Purchases are processed through the Apple App Store or Google Play Store and are subject to the respective store's terms and refund policies.
- We reserve the right to modify premium features, pricing, or availability at any time.
5. User Content
- You retain ownership of all dream entries and content you create within the App.
- You are solely responsible for the content you input. Do not input content that is illegal or that infringes on the rights of others.
- By using the AI interpretation feature, you grant Somnia a limited, non-exclusive license to transmit your dream content to AI service providers solely for the purpose of generating interpretations.
6. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Exploit AI features to generate harmful, abusive, or illegal content
- Circumvent any access controls, including premium feature restrictions
- Use the App to harm, threaten, or harass others
- Misrepresent AI-generated content as professional advice to others
7. Intellectual Property
All content, design, code, and trademarks associated with Somnia are the property of the App's developers. You may not reproduce, distribute, or create derivative works without prior written consent.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMNIA AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO: RELIANCE ON AI-GENERATED INTERPRETATIONS, DATA LOSS, EMOTIONAL OR PSYCHOLOGICAL DISTRESS, OR INABILITY TO ACCESS THE APP. THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES.
9. Indemnification
You agree to indemnify and hold harmless Somnia and its developers from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your reliance on AI-generated content.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice.
11. Changes to Terms
We may modify these Terms at any time. Continued use of the App after modifications constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.
